Under the Georgia workers' compensation system, the only way to reach a settlement is for the parties to agree to a settlement amount. This is a voluntary process, and no court can force the parties to settle a Georgia workers' comp claim. However, most cases eventually settle as both the injured worker and insurance company have an incentive to reach a settlement. Once the parties agree on a settlement amount, they both sign settlement documents. Those documents are then sent to the Georgia State Board of Workers' Compensation for approval.
